Welcome to Pickometer. These Terms of Service ("Terms") govern your access to and use of the Pickometer website, located at pickometer.com (the "Service"), operated by Pickometer ("we", "us", or "our"). Please read these Terms carefully before using the Service. By accessing or using any part of the Service, you agree to be legally bound by these Terms. If you do not agree to all of the Terms, then you may not access or use the Service.
1. Acceptance of Terms
By creating an account, casting a vote, or simply browsing Pickometer, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
We reserve the right to update or change these Terms at any time. We will indicate the date of the most recent revision at the top of this page. Your continued use of the Service after any changes constitutes your acceptance of the new Terms. It is your responsibility to check this page periodically for updates.
2. Eligibility
You must be at least 13 years of age to use the Service. By using Pickometer, you represent and warrant that you meet this age requirement. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13. If we become aware that a child under 13 has provided us with personal information, we will take steps to delete such information.
3. User Accounts
When you create an account on Pickometer, you are responsible for maintaining the security and confidentiality of your login credentials, including your password. You agree to accept responsibility for all activities that occur under your account. You must notify us immediately at hello@pickometer.com of any unauthorised use of your account or any other breach of security.
You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. We reserve the right to suspend or terminate your account if any information provided is found to be inaccurate, false, or incomplete, or if you violate any provision of these Terms.
You may not use another person's account without permission. You may not create multiple accounts for the purpose of manipulating votes or circumventing any restrictions placed on your account.
4. Acceptable Use of the Service
You agree to use Pickometer only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the Service. Prohibited behaviour includes, but is not limited to:
- Using the Service in any way that violates applicable local, national, or international laws or regulations.
- Attempting to manipulate voting results through the use of bots, scripts, automated tools, multiple accounts, VPNs, or any other means.
- Submitting, posting, or transmitting content that is unlawful, defamatory, obscene, offensive, hateful, or otherwise objectionable.
- Impersonating any person or entity, or falsely representing your affiliation with any person or entity.
- Engaging in any conduct that restricts or inhibits any other user from using or enjoying the Service.
- Attempting to gain unauthorised access to any part of the Service, its servers, or any systems connected to the Service.
- Introducing viruses, trojans, worms, logic bombs, or other malicious or technologically harmful material.
- Harvesting or collecting email addresses or other contact information of other users without their consent.
- Using the Service for any commercial solicitation purposes without our prior written consent.
5. Voting Rules and Integrity
Pickometer is built on the principle of fair, authentic community voting. Each registered user may cast one vote per matchup in each category. Voting requires a free account, which allows us to enforce this limit and keep results trustworthy.
Any attempt to cast multiple votes, inflate or deflate vote counts, or otherwise manipulate the outcome of any matchup is a serious violation of these Terms. We reserve the right to remove fraudulent votes, reverse manipulated results, suspend accounts, and permanently ban users who engage in such behaviour. We may use automated systems and manual review to detect vote manipulation.
6. User-Submitted Content
Pickometer allows users to contribute content to the platform, such as comments ("User Content"). By submitting User Content, you grant Pickometer a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.
You represent and warrant that you own or have the necessary rights to the content you submit, that the content does not infringe any third-party intellectual property rights, and that the content complies with all applicable laws. You are solely responsible for any User Content you submit.
All User Content is subject to moderation. We reserve the right, but are not obligated, to review, edit, or remove any User Content at our sole discretion and without notice. Content that violates these Terms, our community guidelines, or applicable law will be removed.
7. Content Moderation
We strive to maintain a respectful and constructive community. We reserve the right to reject, edit, or remove any content that we determine, in our sole discretion, to be inappropriate, misleading, harmful, or in violation of these Terms. Repeated violations may result in the suspension or permanent termination of your account.
8. Intellectual Property
The Pickometer name, logo, website design, and all related graphics, text, and software are the intellectual property of Pickometer and are protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works of any Pickometer content without our prior written permission.
You may not use the Pickometer name, logo, or any of our trademarks in any manner that is likely to cause confusion, or in any manner that disparages or discredits Pickometer.
9. Third-Party Links and Advertising
The Service may contain links to third-party websites or services that are not owned or controlled by Pickometer. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. We strongly advise you to read the terms and privacy policy of any third-party site you visit.
Pickometer may display advertisements served by Google AdSense and other third-party advertising networks. These advertisers may use cookies and web beacons to serve ads based on your prior visits to our site and other sites on the internet. You may opt out of personalised advertising by visiting Google's Ads Settings.
10. Disclaimer of Warranties
The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that any defects will be corrected.
The results, rankings, and voting data displayed on Pickometer reflect the opinions of our community and are provided for entertainment and informational purposes only. They do not constitute professional advice of any kind.
11. Limitation of Liability
To the fullest extent permitted by applicable law, Pickometer and its directors, employees, partners, agents, suppliers, or affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the Service, any conduct or content of any third party on the Service, or any content obtained from the Service.
12. Indemnification
